Terms & Conditions

Upon receipt of the initial invoice, Preserve Your Memories and you, “The Client”, agree to the below terms.

 

1. Payment by The Client must be made to Preserve Your Memories within 7 days of receipt of a valid tax invoice. Preserve Your Memories reserve the right to withhold The Client’s original media until payment is made in full.
    

2. In the case of cancellation, The Client must notify Preserve Your Memories in writing. If work has commenced, The Client will be charged for the total work already completed
    

3. By submitting prints or documents to Preserve Your Memories, The Client agrees that their value is no greater than the cost of scanning the same quantity of items. For example, if a photograph costs $0.30 to scan, The Client may claim no more than the same value for damages. Except for said agreed value, Preserve Your Memories shall not be liable for any other damages.
    

4. Preserve Your Memories shall not be liable for the failure of any data storage devices provided to The Client, or the loss of any data as a result of the failure of said devices.
    

5. Preserve Your Memories observe Australian Copyright Laws. By submitting your photographs to be scanned, The Client acknowledges that they own the rights to the images. If you submit photographs that are identifiable as the work of professional artists, Preserve Your Memories will return said items unscanned.
    

6. Preserve Your Memories agrees that all scanned images are the property of The Client, and as such agrees not to on-sell, distribute or use any media without gaining written permission from The Client.
    

7. Preserve Your Memories will store The Client’s digital images for a total of six months for the purposes of ensuring the safe back-up of said images, after which all image files will be permanently deleted. Should The Client not wish Preserve Your Memories to store their image files after the completion of all work, they must notify Preserve Your Memories in writing.
